Servicing & Parts

 

Your contract with Push Performance Power Ltd trading as Push Performance

 

Please read the terms and conditions detailed below. If there is anything you would like clarification on please do not hesitate to contact us at info@pushperformance.co.uk

 

Once a sale transaction has been agreed and a deposit payment has been received by Push Performance the contract is effective. The necessary arrangements will be put into place. Therefore cancellation or withdrawal of an order will result in the deposit amount being held by Push Performance.

 

While Push Performance will make every effort to deliver the vehicle or parts ordered by the estimated delivery date, we will not be liable for any claim for compensation of any description that may result from delay due to reasons beyond our control. If delay arises in this way, we will contact you to agree an alternative delivery date.

 

If you, the purchaser, cannot pay for and/or take delivery of your vehicle or parts within 21 days of us notifying you that the vehicle is ready, we will treat the contract as cancelled. If this happens or you cancel the contact for any other reason, we will sell the vehicle or parts to another party. Push Performance will be entitled to recover additional costs we incur in reselling the vehicle plus any reduction in the sale price achieved. If it is not sold within a reasonable time frame, we will sell the vehicle or parts at auction.

 

The vehicle will belong to Push Performance until the total purchase price has been paid in full and cleared our bank account. A cheque or bankers draft will not be treated as payment until it has been cleared by the bank.

 

If the vehicle ordered is new Push Performance will undertake pre-delivery work specified by the manufacturer. All vehicles will be sold with the benefit of the manufacturer's warranty, a Push Performance supplied warranty or a third party warranty. Warranty applies to road use only, unless otherwise agreed.

 

If the manufacturers recommended price or Push Performance selling price is significantly increased we will liaise with you so that the necessary arrangements can be made.

 

If we are unable to deliver the specific model of vehicle ordered because the manufacturer ceases manufacturing whether before or after the estimated delivery date, we may cancel the contract and refund any deposit you have paid in full.

 

Push Performance endeavours to correctly market each product/vehicle, however, we cannot be held responsible for errors in published details.

 

Push Performance require the purchaser to collect their new vehicle in person from our premises.

 

Where you wish to sell us a vehicle in part exchange, the value as agreed by Push Performance will be reduced from the purchase price of the vehicle we agree to supply, provided that you own the vehicle to be taken in part exchange and its ownership can be transferred to Push Performance.

 

Outstanding finance is declared and cleared prior to being transferred to Push Performance.

 

The part exchange vehicle should be delivered in the same condition as it was on inspection prior to the sales contract. Ownership of the part exchange vehicle will transfer to Push Performance on the day of handover.

 

If you fail to satisfy any of these conditions we will not be obliged to accept your vehicle in part exchange. If a compromise cannot be agreed, the purchaser may be required to pay the whole purchase price for the vehicle supplied by Push Performance.

 

Push Performance cannot guarantee the appearance and/or colours of products presented on the website. All sizes and dimensions are approximate.

 

Push Performance take every care to test the quality and performance of our goods and services however we cannot guarantee specific performance expectations.

 

Upgrading vehicle performance can affect the vehicles reliability and will require more frequent maintenance. Push Performance take no responsibility for component failure after upgrades have been installed.

 

Push Performance offers no warranty on vehicles upgraded unless specifically put in writing to the customer. If a warranty is provided this agreement does not cover circuit use, sprints or timed events as per most manufacturer warranties.

 

Any warranty provided is non transferrable.

 

If your parts order is faulty or damaged on delivery we will endeavour to exchange the product or issue a refund. Goods must be returned to Push Performance in original packaging without being installed or used with all relevant seals and enclosures intact within 14 days of receipt.

 

Parts removed during a service/upgrade/general repairs, if not collected within 4 weeks, will be disposed of by Push Performance.

 

Parts are subject to variations in pricing due to exchange rate fluctuations and external pressures. You will be notified if prices change after an order has been placed. Payment must be made prior to despatch. Full address details and contact details must be provided at point of ordering. Push Performance reserve the right not to supply a company or individual at our discretion.

 

Communication between Push Performance and the purchaser can be by several different means. Telephone, mobile telephone, email, letter and in person. We require viewing to be arranged strictly by appointment. Communication and calls maybe recorded for quality control, security, training purposes and dispute resolution.

 

Push Performance shall not be liable to the purchaser where compliance of our obligations to the purchaser are prevented by reasons out of the control of Push Performance, such as acts of God, war, civil commotion, accident, strike, lock outs, Marshmallow Men, trade disputes, acts or restraints of government, imposition or restrictions of imports or exports.

 

This agreement is subject to the relevant United Kingdom law and the relevant courts of the United Kingdom.

Sale & Return

 

In the following terms and conditions:-
“Push Performance” is the trading name of Push Performance Power Ltd, the terms “We” and “Us” refers to Push Performance either alone or together with you, as the context requires; “You” means the person ordering goods subject to these terms and conditions;

 

1. Prices and Payment

 

The prices for the goods displayed in the online shop are in Pounds Sterling (GBP) and are exclusive of VAT (Value Added Tax). The applicable VAT charges (if applicable) and delivery costs will be displayed and added to the overall cost of the order when proceeding with payment.

 

The order will not be accepted until valid contact details and payment details have been supplied. Online card payments are processes through the secure WorldPay Online Gateway.

 

2. Consumers Rights of Withdrawal (For Customers Within The EU)

 

Under EU legislation (Directive 97/7/EC) distance bought items are covered by a seven day returns period which begins on receipt of the goods. The cost of returning the goods remains the obligation of the customer. If you wish to cancel the order you can email us at info@pushperformance.co.uk.

 

3. Our returns and refunds policy

 

If the parts are faulty or damaged on delivery we will endeavour to exchange the product or issue a refund. Goods must be returned to Push Performance in original packaging without being installed or used with all relevant seals and enclosures intact within 14 days of receipt.

 

If you have ordered in error, subject to a restocking charge of not less than 10% of the value of the order we will issue a refund ( *exclusions apply). Goods must be returned to the Company in original packaging (and without being installed or used and with all relevant seals and enclosures intact) within 14 days of receipt by the buyer.

 

Online shop refunds can be processed by Push Performance on the same day, but can take between 5-10 working days for funds to appear in your account due to bank clearance times.

 

In all circumstances any action shall be subject to the buyer producing proof of purchase and returning goods carriage paid.

 

* Exclusions: Products made to specific requirements or non stock items specifically ordered are excluded.

 

This does not affect your statutory rights.

 

4. General

 

We shall not be liable to you where performance of any of our obligations to you is prevented, frustrated or impeded by reason of acts of God, war and other hostilities, civil commotion, accident, strikes, lock outs, trade disputes, acts or restraints of Government, imposition or restrictions of imports or exports or any other cause not within the reasonable control of Push Performance.

 

Please ensure that you have received and checked your order in full before arranging fitment or installation of parts as no liability will be accepted for any costs incurred.

 

If any part of these terms and conditions is found to be unenforceable as a matter of law, all other parts of these terms and conditions shall not be affected and shall remain in force.

 

We cannot guarantee that the appearance and/or colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. All sizes quoted are approximate.

 

To the extent permitted by law, Push Performance accepts no liability for any loss, damage or injury arising as a consequence of the advice provided.

 

This agreement is subject to the relevant United Kingdom law and the relevant courts of the United Kingdom.
